While we understand that Governor Cuomo has issued an executive order allowing taxing jurisdictions to collect taxes for 2018 in order to claim a tax deduction before new federal tax laws become effective, as NYS Budget Director Robert Mujica has acknowldged, it is “neither feasible nor practical” for us to be able to do so. All non- “Big 5” school districts would not be in the position to approve a tax warrant in order to allow for tax collection to be made before the end of the year based on the information posted below. THE MILLBROOK CENTRAL SCHOOL DISTRICT CANNOT COLLECT PREPAYMENT OF TAXES FOR THE 2018/2019 SCHOOL YEAR. IF YOU MAILED A PREPAYMENT TO THE SCHOOL TAX COLLECTOR YOUR CHECK WILL BE MARKED VOID AND RETURNED TO YOU.
The district doesn’t have a budget for the 2018-19 school year, a warrant cannot be issued until after we have a voter approved budget or a contingent budget and likely will not be issued until August or September 2018. The tax collection is initiated by the issuance of the warrant and publication of the notice of collection of taxes. There is no authority to collect school taxes until after the voter approved budget, approval and issuance of the warrant and the notice of collection is given.
- 1318. Collecting officer’s warrant; delivery thereof. 1. The warrant of the collecting officer shall be signed by the trustee, or the trustees, or a majority of them, or the board of education or a majority thereof. Such warrant shall state the amount of unexpended surplus funds in the custody of the board and shall further state that except as authorized or required by law, such unexpended surplus funds have been applied in determining the amount of the school tax levy. For the two thousand seven–two thousand eight school year, surplus funds as used in this subdivision shall mean any operating funds in excess of three percent of the current school year budget, and shall not include funds properly retained under other sections of law. For the two thousand eight–two thousand nine school year, and thereafter, surplus funds as used in this subdivision shall mean any operating funds in excess of four percent of the current school year budget, and shall not include funds properly retained under other sections of law. Such warrant shall have the same force and effect as a warrant issued by a board of supervisors to a collecting officer in a town. The collecting officer to whom it may be delivered for collection shall be thereby authorized and required to collect from every person named on such school tax roll the sum set opposite his name, or the amount due from any person specified therein, in the same manner and with the same powers that collecting officers in towns are authorized to collect taxes levied by the board of supervisors.
- A warrant for the collection of a tax voted by the district shall not be delivered to the collecting officer until the thirty-first day after the tax was voted. A warrant for the collection of a tax authorized by law without a vote of the district may be delivered to the collecting officer whenever the same is completed.
- If the sum of money, payable by any person or persons named in such school tax rolls, is not paid or collected by such warrant within the time therein limited, it shall be lawful for the school authorities to renew such warrant in respect to such delinquent person or persons. Whenever more than one renewal of a warrant for the collection of any school tax roll may become necessary in any district, the school authorities may make such further renewal; provided, however, that in no event shall such warrant be renewed for a period beyond the time for the return to the county treasurer as set forth in subdivision two of section thirteen hundred thirty of this chapter.
Mary Alex, Tax Collector, has announced that her office will be accommodating residents that wish to pay their 2018 property taxes in 2017. Tax amounts will be available to property owners calling the office beginning on December 26th. She is working with the software vendor to have the information posted directly to the website as quickly as possible.
For payments to be processed in 2017, payment must be received in the Town Clerk’s office by Friday, December 29th at 12:00 Noon.
Due to the holiday season, the Town Clerk’s office will be operating with a limited staff. Please call during office hours – 677-3419. We have had an overwhelming number of requests for this service and your cooperation in calling the office, rather than leaving a phone message or sending an email, will be very helpful in ensuring all property owners receive fair and equal treatment.
Tax bills will be processed and sent by January 19th. Payments made after February 28th will incur additional fees.
TOWN OF WASHINGTON NOTICE OF RECEIPT OF TAX ROLL AND TAX WARRANT
TAKE NOTICE THAT I, MARY ALEX, Tax Collector of the Town of Washington, Dutchess County, New York, have duly received the tax roll and warrant for the collection of taxes within the Town of Washington for the Year 2018. Collection of Taxes begins December 26, 2017 through February 28, 2018. Checks may be made payable to Mary Alex, Tax Collector, P O Box 667, Millbrook, NY 12545. Payments may be made in person at the Town Hall, 10 Reservoir Drive, Millbrook, NY 12545, Monday – Friday from 9:00 AM – 12:30 PM and 1:30 PM – 3:00 PM, excluding weekends and holidays. The Town Clerk’s Office will be closed on Tuesday, February 20, 2017 to attend training.
TAKE FURTHER NOTICE that taxes may be paid on or before February 28, 2018 without penalty. On all such taxes remaining unpaid, beginning on March 1st, a penalty will be added as follows: March 1 – March 31 – 2 %, April 1 – April 30 – 3 % and May 1 – May 31 – 4%. After April 30, an additional fee of $2.00 will be assessed to any unpaid properties. Beginning on June 1, 2018, the unpaid taxes will be turned over to the Dutchess County Commissioner of Finance, 22 Market St., Poughkeepsie, NY 12601.

Dutchess County will be providing the local municipalities the Tax Warrant and Roll on or before December 28, 2017. Tax Collector Mary Alex will be accepting tax payments once she has received the Tax Warrant.
Residents will be required to call the Town Clerk’s Office for the tax amount that is due. 845-677-3419 PLEASE, do not leave a message on the answering machine requesting that we call you back with the tax amount. The Town has limited staffing and we have had many inquiries on this subject.
Payments will be accepted at the Town Clerk’s office by cash or check, ACH Electronic Transfer, credit card or Visa Debit Card. Tax Collector Mary Alex has worked with the Bank of Millbrook to accept an ACH Electronic Transfer . There is a service fee for payments made by Visa Debit Card, which is $3.95 per transaction. Payments made by Visa, MasterCard, Discover or American Express will have an additional service fee of 2.45% of the payment amount for Tax Payments. Credit Card Payment authorization forms will be posted on the town website when the warrant is available.
